TougeCon Waiver and Release of Liability

This Waiver and Release of Liability ("Waiver") is made and entered into as of the date of ticket acquisition (the "Acquisition Date") by and between TougeCon ("TougeCon"), and the ticket acquirer ("Participant").

WHEREAS, TougeCon is organizing a driving event scheduled for September 7, 2024 (the "Event") where participants will drive their own personal vehicles along a designated route; and

WHEREAS, Participant desires to participate in the Event.

Driver Eligibility: Participant acknowledges and certifies that they are over the age of 18 and hold a valid driver's license for the State in which they reside.

NOW, THEREFORE, in consideration of the foregoing premises and the mutual covenants contained herein, the parties agree as follows:

1. Assumption of Risk. Participant acknowledges that participation in the Event involves inherent risks, including, but not limited to, the risks of traffic accidents, mechanical failure, and personal injury. Participant assumes all risks associated with participating in the Event, whether caused by Participant's own negligence, the negligence of others, or by inherent risks of the Event.

2. Compliance with Laws. Participant agrees to comply with all applicable laws and regulations, including traffic laws and speed limits, during the Event. Participant understands that any violation of laws or reckless driving may result in immediate disqualification from the Event.

3. Waiver and Release of Liability. In consideration of being permitted to participate in the Event, Participant hereby waives, releases, and discharges TougeCon, its officers, directors, employees, volunteers, agents, contractors, promoters, participants, officials, car owners, drivers, crew members, rescue personnel, sponsors, advertisers, owners and lessees of premises used to conduct the Event, premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event (collectively, the "Releasees") from any and all claims, demands, losses, or liabilities arising out of or in any way connected with Participant's participation in the Event, including, but not limited to, personal injury, property damage, or death.

4. Medical Treatment Authorization. Participant hereby authorizes TougeCon to secure necessary medical treatment for Participant in the event of an emergency during the Event. Participant agrees to be responsible for all costs associated with such medical treatment.

5. Passenger Acknowledgment: Participant acknowledges that they are responsible for ensuring all passengers in their vehicle understand the terms of this Waiver and Release of Liability. By signing below, Participant also acknowledges their permission for any minor passengers (under 18 years of age) to participate in the Event.

6. Severability. If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

7. Governing Law. This Waiver shall be governed by and construed in accordance with the laws of the State of Arkansas.

8. Entire Agreement. This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

I ASSUME FULL RESPONSIBILITY FOR ANY AND ALL SUCH RISKS OF BODILY INJURY OR DEATH TO MYSELF, OR OF PROPERTY DAMAGE TO MY PROPERTY arising out of or related to their participation in the Event, even if caused, in whole or in part, by the NEGLIGENCE OF THE OTHER PARTICIPANTS.

IN CONSIDERATION of being allowed to participate in any way in any TougeCon Event, I UNDERSTAND AND AGREE that, although I have been supplied with certain information of the prescribed route, the nature of the route does not permit me to inspect the prescribed route or any portion of the prescribed route or the immediately adjacent areas thereof with which I may come in contact during the Event prior to my participation in the Event. I understand and agree that, if at any time, I feel anything to be UNSAFE, I will immediately take all necessary precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further in the Event.

I understand that participation in the Event involves RISKS AND DANGERS, BOTH KNOWN AND UNKNOWN, of serious BODILY INJURY, including PERMANENT DISABILITY, PARALYSIS, DEATH, and property damage.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE RELEASEES, FROM ALL LIABILITY TO ME, my personal representatives assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO ME OR MY PROPERTY OR RESULTING IN MY DEATH ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE EVENT WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I HEREBY AGREE TO DEFEND, INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from any loss, liability, damage, or costs they may incur due to claims brought against the RELEASEES arising out of my injury or death while I am participating in the Event and WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I HEREBY AGREE that this agreement shall be binding and enforceable against me, my personal representatives, agents, spouse, assigns, heirs, and next of kin without limitation.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18)

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement in this Event, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
